Per Curiam This is an appeal from a district court judgment which granted appellees summary judgment motion. The district court issued the judgment based upon the report and recommendation of a United States Magistrate who found that: (1) appellants allegations of violations of 42 U.S.C. § 1983 did not rise to a constitutional magnitude; and (2) appellants other allegations which sought recovery under the doctrine of respondeat superior have been barred by Monell v. New York City Department of Social Services, 436 U.S. 658 (1978).
